Tom's Biography

As a trial attorney, Tom has been at the forefront of some of the Nation's worst natural and man-made disasters, including counselling businesses affected by the 2010 BP Deepwater Horizon blowout. There he represented several Gulf Coast Area chambers of commerce opposing British Petroleum's Petition for a Writ of Certiorari with the Supreme Court of the United States. Tom also represents claimants in the BP Deepwater Horizon claims appeal process
In addition to his work at the Supreme Court, Tom represents hundreds of individuals, businesses and governmental entities against BP and has been successful in recovering tens of millions of dollars for these clients, both through the BP Court Supervised Settlement Program and elsewhere in MDL-2179.
One of his clients, Christopher J. McIntyre, has a lawsuit pending against BP in the 9th Circuit Court of Appeals, where it is alledged that Mr. McIntyre was the individual who originally concieved of the device that BP eventually used to cap the Macondo Well. In good faith, Mr. McIntyre shared his design with BP in early-to-mid May 2010 as the Deepwater Horizon Disaster was raging. BP subsequently used a design sttrikenly similar to McIntyre's and the company is now attempting to patent the design. Tom, along with Alaska attorney Phillip Weidner, are seeking damages. 
In late 2015 Tom was appointed to represent over 200,000 individuals and Gulf Coast Area businesses in an allocation proceeding involving a $1.24 billion settlement with Deepwater Horizon contractor Halliburton and rig owner Transocean.
Tom's latest work includes representing auto dealers, fleet owners and local governments in lawsuits against Volkswagen for economic losses sustained as a result of the German manufacturer's defective emission control devices.
Tom and his team have a comprehensive understanding of the Oil Pollution Act of 1990, the Clean Water Act, the Clean Air Act, federal and state unfair trade practices laws, and other environmental legislation and regulatory schemes. As a result of this experience, Tom is well versed in complex multi-district litigation practice.
